To purchase art or access certain features, you may be required to register for an account.

You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate, current, and complete information.

We reserve the right to terminate accounts that provide false information or violate these terms.

3. Intellectual Property & Art Rights

This is the most important section for your creative protection:

Ownership of Content: All artwork, images, text, and designs on this Site are the sole property of Her Spirit Creates and are protected by international copyright laws.

Copyright Retention: The purchase of a physical or digital artwork does not transfer copyright to the buyer. We retain all rights to reproduction, distribution, and display.

Prohibited Use: You may not scan, copy, resell, or create derivative works from the artwork purchased or viewed on this Site without express written permission from the artist.

4. Sales & Payments

Platform: Sales are processed via Squarespace. By purchasing, you also agree to Squarespace’s checkout terms.

Pricing: We reserve the right to change prices at any time without notice.

Payments: You represent that you have the legal right to use any payment method provided. All payments are subject to validation checks by the card issuer.

5. Shipping & Risk of Loss

All physical items are shipped according to our Shipping Policy. The "risk of loss" and title for such items pass to you upon our delivery to the carrier (e.g., USPS, FedEx, UPS). We are not responsible for delays caused by the carrier.

6. Refund & Return Policy

Original Art: All sales of original paintings/sculptures are final.

Damaged Items: If an item arrives damaged, please contact info@herspiritcreates.com within 48 hours with photos of the packaging and the product.

7. Limitation of Liability

To the maximum extent permitted by law, Her Spirit Creates shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Site or the purchase of any artwork.

8. Governing Law

These terms are governed by the laws of Vermont, USA. Any disputes shall be resolved in the courts of Vermont, USA.
